(Lat., “You have the body”), a writ directing a person detaining another to produce the party before a court or judge for inquiry into the cause of detention. It is basically used to test the validity of imprisonment and to release the prisoner in the event that the imprisonment is invalid. Originally, the writ was a protective device against arbitrary incarceration, and it still serves to protect personal liberty.
